How do you explain a Revocable Living Trust to someone who may not be familiar with them?
A revocable living trust is one of the most common and effective tools we use in estate planning. It allows individuals, whom we call grantors, to manage their assets during their lifetime while also ensuring those assets are distributed according to their wishes after they pass away.
Think of it like a secure container for your belongings. You, as the grantor, have complete control over what goes into the trust and how it’s managed. You can add or remove assets, change beneficiaries, or even dissolve the trust altogether while you’re alive. Consequently, this flexibility makes it a very attractive option for many people.
Moreover, a key advantage of a revocable living trust is that it avoids probate, which can be a lengthy and expensive legal process. When assets are held in a trust, they pass directly to the beneficiaries named in the trust document, saving time and money for your loved ones during an already difficult time.
Ordinarily, when someone passes away without a will or trust, their assets must go through probate court. This process can take months, sometimes even years, and involve significant legal fees. Avoiding probate through a revocable living trust is a major benefit for your family.
I often meet with families who are going through the probate process after losing a loved one. It’s incredibly stressful and emotionally draining. Seeing them navigate this complex system reinforces why I am so passionate about helping people create trusts beforehand.

While revocable living trusts are generally very effective, there are some potential pitfalls to be aware of. One common issue arises when the trust document is not properly drafted or funded. This can lead to unintended consequences and even invalidate the trust altogether.
I recall a case where a client had created a revocable living trust but failed to transfer all of their assets into it. Consequently, those assets ended up going through probate, defeating the purpose of creating the trust in the first place.
It’s crucial to work with an experienced attorney who can ensure your trust document is comprehensive and accurately reflects your wishes.
What advice would you give to someone considering a revocable living trust?
My best advice is to start the conversation early. Don’t wait until you are facing a health crisis or nearing retirement to think about estate planning. The sooner you address these matters, the better prepared you and your family will be.
