Interview with Steve Bliss of Moreno Valley Probate Law

Good morning, Moreno Valley residents! This is Brenda Lee reporting for Channel 7 News. Today we’re speaking with local probate attorney Steve Bliss of Moreno Valley Probate Law to shed some light on the often confusing process of estate planning.

Steve, can you walk us through one of the key steps in this process?

Certainly, Brenda. One crucial step is marshaling the estate assets. This involves a thorough inventory and appraisal of all the deceased person’s belongings – everything from bank accounts and real estate to personal possessions and investments.

Consequently, it’s essential to meticulously document each asset’s value. We then file this information with the court in the form of an Inventory and Appraisal (Forms DE-160/161). This step ensures transparency and accountability throughout the probate process.

Ordinarily, this stage proceeds smoothly, but there have been instances where discovering hidden assets or determining their true value presents a challenge. I recall one case where a client’s grandfather had stashed away a considerable sum of money in old tins buried in his backyard!

Notwithstanding such surprises, the goal is to provide a clear and accurate picture of the estate’s financial standing. This information is crucial for paying debts, taxes, and ultimately distributing assets according to the deceased person’s wishes.

Have you ever encountered difficulties during this stage?

Well, Brenda, as I mentioned, sometimes uncovering all the assets can be tricky. People may have forgotten about old accounts or investments, making it necessary for us to conduct thorough research.

Moreover, valuing certain assets, like antique furniture or collectibles, can require expert appraisal. In those cases, we often enlist the help of specialized professionals to ensure a fair and accurate valuation.

What advice would you give our viewers regarding estate planning?

Brenda, the best thing people can do is plan ahead. Don’t wait until it’s too late. By creating a will or trust and keeping records organized, you can make the probate process significantly smoother for your loved ones.
