What Type of Trust Do You Recommend Most Often?
Steve: I find that revocable living trusts are a great option for many of my clients. They offer flexibility during the grantor’s lifetime, allowing them to manage and change the trust as needed. Conversely, upon their death, the trust becomes irrevocable, ensuring that assets are distributed according to their wishes.
One significant benefit of a revocable living trust is its ability to avoid probate. Probate is a lengthy and expensive legal process that can tie up assets for months or even years. Consequently, by using a trust, your heirs can receive their inheritance more quickly and efficiently.
Have You Ever Encountered Issues with Revocable Living Trusts?
Steve: While revocable living trusts are generally effective, I have encountered situations where clients didn’t properly fund the trust. This means they failed to transfer ownership of assets into the trust. As a result, those assets would still be subject to probate.
I recall one instance where a client came to me after her husband passed away. He had created a revocable living trust but hadn’t transferred their primary residence into it. Consequently, his share of the home had to go through probate, which caused unnecessary delay and expense for my client.
