Steve, can you walk us through one of the key steps in the estate planning process?
Certainly. One crucial step is “Marshaling the Estate Assets.” This involves systematically identifying and inventorying all assets belonging to the deceased person’s estate.
Consequently, we need to look at everything from bank accounts and real estate holdings to investments, vehicles, personal property, and even digital assets. It’s important to be thorough because any asset not properly accounted for could lead to complications later on.
Ordinarily, we’ll compile a detailed list of all assets, along with their estimated values. This information is then formally documented in an “Inventory and Appraisal” (Forms DE-160/161) which is filed with the court.
I recall one instance where we uncovered a forgotten safety deposit box containing valuable jewelry and important documents. The family had no idea it existed, and discovering it brought them both closure and financial relief.
It’s estimated that approximately 70% of estates require some form of probate (Source: American Bar Association). This highlights the importance of understanding this process and seeking professional guidance when needed.
Challenges and Solutions
Are there ever any challenges associated with marshaling assets?
Yes, sometimes locating assets can be tricky. A common issue arises when individuals haven’t kept their financial records well-organized. This can make it difficult to track down all accounts and investments.

My goal is always to navigate these challenges with empathy and professionalism. I remember working with a family who was struggling to locate their father’s will. After extensive research and communication with various institutions, we were able to uncover the document, which brought them immense peace of mind.
